Classic Snack eGift Cards
By purchasing an eGift Card, you agree to our Gift Card Terms and Conditions (listed below). eGift Cards are emailed to recipients within one hour after you place your order or at the designated time you selected. There’s no expiration date or hidden fees on eGift Cards. You can redeem one Classic Snack eGift Card per order. eGift Cards are not returnable, refundable or redeemable for cash except as required by law. eGift Cards cannot be purchased with coupons, promotional offers, or other Classic Snack eGift Cards. Use eGift Cards to shop on the Site. eGift cards purchased on ClassicCookie.com cannot be redeemed to purchase snacks on ClassicSnack.com. Sold and delivered by Classic Snack.

Purchase, acceptance, or use of the Classic Snack eGift Card means accepting the following terms:

General Terms: Classic Snack eGift Cards are issued by Classic Snack who is the sole obligor to the Gift Card owner. Distributed at ClassicSnack.com by Mannon Specialty Foods, LLC. Purchase and/or use subject to Classic Snack’s Terms of Use, including arbitration agreement. Mannon Specialty Foods, LLC. reserves the right to change these Classic Snack eGift Card Terms & Conditions from time to time in its discretion. eGift cards include digital gift cards (or “eGift Cards”), or other digital stored value cards (collectively “Gift Card”, “Gift Cards”, “Classic Snack Gift Card” or “Classic Snack Gift Cards”).

Gift Cards Redemption: Redeemable for merchandise and services purchased by residents of the contiguous United States at ClassicSnack.com. eGift Cards cannot be purchased with coupons, promotional offers, and are not subscription eligible. eGift Cards cannot be used to buy other gift cards or similar stored value products. You are limited to the use of one Classic Cookie eGift Card per order. Except if disclosed in the eGift Card email or otherwise, Classic Snack Gift Cards do not expire. There are no fees on any Classic Snack Gift Cards. Gift Cards are not redeemable for cash, except where required by law in particular states. eGift Cards are not transferable from one Classic Snack account to another. If a purchase exceeds your total Gift Card balance, the remaining amount must be paid with another payment method.

Purchase Limitations: Unused eGift Cards may not be transferred. If you return merchandise originally purchased with an eGift Card, any refund will be issued to the Gift Card or in the form of another eGift Card. Any merchandise purchased with an eGift Card is subject to the applicable store or online return policies. Classic Snack eGift Cards may be used as personal or business gifts, but may not be reloaded, resold, used for payment outside of www.classicsnack.com, or used by any third party in connection any marketing, advertising, or other promotional activities.

View Your Balance: To review your gift card balance, please contact our team at contact@classicsnack.com. Please share the original gift card email or the unique number of the gift card with our team to expedite the search process for you.

Returns: You may not return or cancel your Classic Snack eGift Card after activation. If you received a Gift Card because of a promotion where a purchase of a product is required, and you subsequently return the qualifying product(s) or the order is otherwise cancelled prior to shipment, Classic Snack may cancel the promotional eGift Card or deduct the value of the promotional eGift Card you received from the amount refunded to you upon return of the item.

Lost or Stolen eGift Cards: If you suspect that someone has copied or stolen your eGift Card, contact 1-877-933-5444 immediately. eGift Cards will not be replaced if lost or stolen without proof of purchase. Only the remaining balance on a lost or stolen eGift Card may be provided on a replacement eGift Card. eGift Cards have cash value and should be safeguarded accordingly. Promotional Cards will not be replaced under any circumstances.

Privacy: Personal information that you provide to Classic Snack. when purchasing or using an eGift Card is subject to Classic Snack’s Privacy Policy.

Risk of Loss: Ownership and risk of loss of an eGift Card passes to the purchaser as soon as Classic Snack sends the eGift Card to the recipient email address designated by the purchaser. Mannon Specialty Foods, LLC and Classic Snack are not responsible for lost, stolen, or misdirected eGift Cards. It is the purchaser’s responsibility to provide a correct and updated email address for the recipient.

Delivery Information and Requirements for Gift Card Purchasers:
If you have concerns about your order and delivery of an eGift Card you have purchased, please contact us at 1-877-933-5444 or contact@classicsnack.com. Please refer to your order number or be ready to supply your email address. Mannon Specialty Foods, LLC and Classic Snack are not responsible for eGift Cards that are undeliverable or not received due to your failure to enter an accurate email address for the recipient. Please check to make sure the email address of the recipient is correct and contact 1-877-933-5444 if you suspect the recipient did not receive his/her eGift Card.

Reasons for Failed Delivery: eGift Cards are delivered via email. If you have confirmed the recipient's email address but the eGift Card has not been viewed within a reasonable period after the requested delivery date, the following is a list of the most common reasons why delivery may have failed:
1. Spam filter blocked the email or routed it to a bulk/spam folder
2. The recipient's firewall blocked the email
3. Email inbox is over the size limit
4. Invalid email address

If a spam filter is blocking Classic Snack emails from getting to an inbox, the email options will need to be modified so that emails from contact@classicsnack.com are not considered spam. If you need further assistance, contact 1-877-933-5444. Please refer to your order number or be ready to supply your email address.

Violation of These eGift Card Terms and Conditions: You agree to not use Classic Snack Gift Cards in any manner that is misleading, deceptive, unfair, or otherwise harmful to Mannon Specialty Foods, LLC, its affiliates, including Classic Snack, or their customers. We reserve the right, without notice to you, to void Gift Cards (including a portion of your Gift Card balance or particular Gift Card purchase) without a refund, suspend or terminate customer accounts, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment if we suspect that a Gift Card is obtained, used, or applied to a Classic Snack account fraudulently, unlawfully, or otherwise in violation of these Classic Snack Gift Card Terms and Conditions.

Governing Law and Disputes: You and Mannon Specialty Foods, LLC hereby agree that any dispute relating in any way to a Classic Snack eGift Card shall be resolved under the Law of the State of Tennessee.
Subscriptions
Snack subscriptions are a wonderful way for customers to get recurring orders of Classic Snack products at a discounted price. This feature is available to customers who sign up for a free Cookie Snack account. You must register for this account, which includes providing certain information about yourself as prompted by our registration form. Please see our terms for a Cookie Snack account to the left.

When you purchase product(s) on ClassicSnack.com and enroll in our Subscription program, you are signing up for continuous shipments of such products and may select how often you would like your product(s) delivered to you before checking out. If you need to make changes to your subscription after you have placed your order and checked out, you must cancel your current subscription and then start a new subscription order through ClassicSnack.com. To cancel your subscription, you must reach out to Classic Snack representatives by calling 877-933-5444 or emailing contact@classicsnack.com, and they will cancel the subscription for you.

A customer has the right to cancel their subscription order at any time. Once a customer cancels their subscription, they will not get a subscription discount on future orders automatically, unless they select a subscription option for that order. Customers who abuse the subscription method are subject to penalties as deemed fit by Classic Snack.

Classic Snack reserves the right to change subscription benefits at any time in its sole discretion, including discount amounts and eligibility used to determine discount amounts; provided, however, Classic Snack will not change the price of your next shipment once you have authorized an order as set forth in these Terms. Some of the offer details may change as you receive deliveries over time (for example, price, taxes, availability, shipping charges). Subscriptions are good while supplies last.

When you sign up for continuous shipments on subscriptions, you will be required to expressly agree to permit us to charge your chosen payment method on a recurring basis, as well as the amount of the charge, which amount shall be set as described below. Classic Snack will submit periodic charges (e.g. monthly) to your chosen payment method without further authorization from you, until you provide prior notice at any time that you wish to cancel or to change your payment method. Approximately 24 hours prior to your designated ship date, your order will be authorized, and a payment authorization hold will be placed on your chosen payment method. Once your order is processed, your payment method will be charged for the authorized amount. For clarification purposes only, a payment authorization hold is not an actual charge, i.e, if an authorization hold is placed for $49 on January 1 and your payment method is charged $49 on January 2 when your order is shipped, you will only see one actual charge on your payment method on January 2 for $49. An authorization hold may impact the amount of remaining credit available to you under your chosen payment method.

We may, in our sole discretion, change these Terms, (including all applicable terms, conditions, limitations and requirements on the ClassicSnack.com website) without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED PARTICIPATION AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR SUBSCRIPTIONS.
The charge for each subscription item shipment will be billed to the payment method used to create your subscription or as otherwise directed by you. If we are unable to complete your order with the payment method you used to create your subscription, we will notify you and give you the opportunity to add another payment method to your account and to charge the payment method for your subscription order.
Your subscription will remain in effect until it is cancelled. You can cancel at any time by contacting Classic Snack at 877-933-5444 or contact@classicsnack.com.
Pricing
Classic Snack cannot confirm the price of an item until you submit an order. If you choose to purchase a subscription, the price of an item will be set at the time the order is processed. By confirming your purchase at the end of the checkout process, you agree to accept and pay for the Products as well as all shipping and handling charges and applicable taxes. Classic Snack will collect and remit sales tax as required by law.
Order Acceptance
​The receipt of an order number or an email order confirmation does not constitute the acceptance of an order or confirmation of an agreement to sell. Classic Snack reserves the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any customer. Verification of information may be required prior to the acceptance of an order. Prices and availability of Products are subject to change without notice. Errors will be corrected when discovered, and Classic Snack reserves the right to revoke any stated offer and to correct any error, inaccuracy, or omission (including after an order has been submitted). Certain orders constitute improper use of the Site. Classic Snack reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Your Classic Snack account may also be restricted or terminated for any reason, at Classic Snack's sole discretion.
Snack Loyalty Club
In order to use certain features of our website, you must register for an account with Classic Snack under the Snack Loyalty Club. When registering, you will be prompted to provide certain information about yourself. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information and update it as necessary; and(c) your use of our website does not violate any applicable law or regulation or these Terms.

You are responsible for maintaining the confidentiality of your Cookie Snack Account login information. You are fully responsible for all activities that are associated with your Cookie Snack Account (including but not limited to any purchases, posting reviews, or other use of the Site). You agree to keep your username and password information confidential and not share it with anyone. You agree to immediately notify Snack Loyalty Club of any unauthorized use or suspected unauthorized use of your Cookie Snack account or any other actual or potential breach of security.
Product Descriptions
Classic Snack attempts to be as accurate as possible. However, Classic Snack does not warrant that Product descriptions, depictions, colors, dimensions, ingredient lists, or other content on the Site are accurate, complete, reliable, current, or error-free. If a Product offered by Classic Snack is not as described, your sole remedy is to return the Product. Call us at 1-877-933-5444 or send an email contact@classicsnack.com for return information.

Products are made in conjunction with brands like Hershey’s, Reese’s, and Cinnabon. The HERSHEY’S trademark and trade dress on product packaging are registered trademarks of The Hershey Company. The REESE’S trademark and trade dress on product packaging are registered trademarks of The Hershey Company. CINNABON® AND THE Cinnabon logo are registered trademarks of Cinnabon LLC.
Acceptable Use Policy
In connection with your use of the Site and interactions with Classic Snack and its employees and users, you agree not to collect, upload, transmit, display, communicate by email, telephone or electronically, or distribute any User Content (a) that violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy rights, right of publicity, or any other intellectual property or proprietary right; (b) that is unlawful, harassing, abusive, tortious, threatening, harmful, abusive, invasive of another's privacy, vulgar, defamatory, false, intentionally misleading, trade libelous, pornographic, obscene, patently offensive (e.g., material that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual) or otherwise objectionable material of any kind or nature or which is harmful to minors in any way; or (c) in violation of any law, regulation, or obligations or restrictions imposed by any third party.

In addition, you agree not to use the Site to: (a) upload, transmit, or distribute any computer viruses, worms, or any software intended to damage or alter a computer system or data; (b) send unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (c) harvest, collect, gather or assemble information or data regarding other users, including e-mail addresses, without their consent; (d) interfere with or disrupt servers or networks connected to the Site or violate the regulations, policies or procedures of such networks; (e) attempt to gain unauthorized access to the Site, other computer systems or networks connected to or used together with the Site, through password mining or other means; (f) harass or interfere with another user's use and enjoyment of the Site; (g) purchase Products for resale.
We reserve the right (but have no obligation under these Terms of Use) to review any User Content, investigate, and/or take appropriate action against you, at our sole discretion, if you violate the Acceptable Use Policy or any other provision of these Terms, including removing or modifying your User Content, terminating your Cookie Snack Account, and/or reporting you to law enforcement authorities. We may also remove or modify your User Content if it, in our sole judgment, violates the rights of, harms, or threatens the safety of any other person, or creates liability for us or any other person. In order to cooperate with legitimate governmental requests, subpoenas or court orders, or to protect our business and members, we may access and disclose any information we consider necessary or appropriate, including your Snack Loyalty Club Account username and password, Internet Protocol (IP) address and traffic information, usage history, and your User Content.
Risk of Loss and Shipping and Delivery
All items purchased from Classic Snack are made pursuant to a shipment contract with a shipping carrier. This means that the risk of loss and title for such items passes to you upon delivery of the Products to the carrier. Products will be shipped to the address designated by you, if applicable, so long as such address is complete and complies with any shipping restrictions contained on our website. The time and location of delivery of the Products to you is at the discretion of the carrier.
Intellectual Property Rights
The Classic Snack website contains valuable trademarks and service marks owned, controlled, or used by or licensed to Classic Snack and Mannon Specialty Foods, LLC, including but not limited to, Classic Snack, Classic Cookie, the Classic Snack design logo, the Classic Cookie design logo, and certain brands including HERSHEY’S®, REESE’S®, and CINNABON® (collectively, the "Marks"). Any use of the Marks without the prior written permission of Classic Snack is strictly prohibited. The arrangement and layout of the Site, including but not limited to the Marks, images, text, graphics, buttons, screenshots, and other content or material, are the sole and exclusive property of Classic Snack.

UNAUTHORIZED COPYING, REPRODUCTION, MODIFYING, REPUBLISHING, UPLOADING, DOWNLOADING, POSTING, TRANSMITTING, MAKING DERIVATIVE WORKS OF, OR DUPLICATING ALL OR ANY PART OF THE SITE IS PROHIBITED.
Other Users (Third Party Sites)
The Site may contain links to, or advertisements for, third-party websites (collectively, "Third Party Sites") (for example, social media sites such as Facebook, YouTube, Twitter, Pinterest, TikTok, etc.). Such Third Party Sites are not under the control of Classic Snack, and Classic Snack is not responsible for any Third Party Sites. Classic Snack provides links to these Third Party Sites only as a convenience and does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third Party Sites. You agree that you use all Third Party Sites at your own risk. When you link to a Third Party Site, the applicable service provider's terms and policies, including privacy and data gathering practices, govern. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any Third Party Site.

You hereby release us, our officers, employees, agents, affiliates, subsidiaries, parents, joint ventures, successors and any other companies under common control with us from claims, demands any and all losses, damages, rights, claims, and actions of any kind including personal injuries, death, and property damage, that are either directly or indirectly related to or arise out of any interactions with or conduct of other Site users or Third Party Sites.
Limitation on Liability
IN NO EVENT SHALL CLASSIC SNACK, OUR OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUBSIDIARIES, PARENTS, JOINT VENTURES, SUCCESSORS AND ANY OTHER COMPANIES UNDER COMMON CONTROL WITH US, OR ANY INDEPENDENT CONTRACTORS, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFIT OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM OR IN ANY WAY RELATED TO YOUR RELATIONSHIP WITH CLASSIC SNACK, YOUR USE OF THE SITE, PRODUCTS, OR THIRD PARTY SITES, OR YOUR INTERACTION WITH OR RELIANCE ON ANY ADVICE FROM ANY SUCH PERSON OR ENTITY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ACCESS TO, AND USE OF, THE SITE, PRODUCTS, AND THIRD PARTY SITES AND ANY INTERACTIONS WITH OR RELIANCE ON ADVICE FROM ANY SUCH PERSON OR ENTITY ARE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE IN CONNECTION THEREWITH, INCLUDING BUT NOT LIMITED TO YOUR COMPUTER SYSTEM OR LOSS OF DATA RESULTING THEREFROM. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR IN ANY WAY RELATED TO YOUR RELATIONSHIP WITH CLASSIC SNACK, ANY INTERACTIONS WITH OR RELIANCE ON ADVICE FROM ANY SUCH PERSON OR ENTITY, OR THESE TERMS (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION), WILL AT ALL TIMES BE LIMITED TO THE GREATER OF (A) FIFTY US DOLLARS ($50) OR (B) AMOUNTS YOU'VE PAID CLASSIC SNACK IN THE PRIOR 12 MONTHS. WE AGREE THAT ANY CLAIM BETWEEN US MUST BE BROUGHT WITHIN TWO (2) YEARS OF THE EVENT(S) GIVING RISE TO SUCH CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU, AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
Indemnity
You agree to indemnify and hold Classic Snack harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to or arising out of (a) your use of the Site or Products, (b) your User Content, (c) your violation of these Terms, or (d) your interaction with such independent contractors or reliance on any advice provided by them. Classic Snack reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Classic Snack. Classic Snack will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
General
We reserve the right to make changes to our Site at any time, including but not limited to our Terms, our Privacy Policy, Subscription Terms & Conditions, Classic Snack eGift Card Terms & Conditions, and any other terms and conditions that may apply to our Site and/or Products, programs, and services. Each time you use our Site, you should visit and review the current terms and policies that apply to your transactions and use of our Site. If you do not agree to be bound by the current terms and policies, your sole remedy is not to use our Site. If any provision of these Terms is deemed invalid, void, or for any reason unenforceable, any such term shall be deemed severable and shall not affect the validity and enforceability of any other terms.
Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. The word "including" means including without limitation. If any provision of these Terms is, for any reason, held to be invalid or unenforceable, the other provisions of these Terms will be unimpaired and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law. The Terms of Use, and your rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by you without Classic Snack’s prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void. The Terms shall be binding upon assignees.
